Deutsche Beibehaltungsgenehmigung(German Retention Certificate)
We are one of the very few law firms in the United States that almost solely focuses on assisting our German clients in retaining their German citizenship while obtaining their United States citizenship. Unlike most other countries, Germany takes away its citizenship if one of their citizens obtains new, foreign citizenship. For most German citizens that is not an option. Yet having made the United States their home, and facing many disadvantages and uncertainties as a non United States citizen, naturalizing is often of great importance.
Fortunately, there is a process that provides an opportunity for German citizens to apply for permission to keep their citizenship when obtaining foreign citizenship. It is called the “Genehmigung zur Beibehaltung der deutschen Staatsangehörigkeit” based on § 25 II StAG. It is a relatively complicated process that requires a successful application to the Bundesverwaltungsamt (Federal Office of Administration) in Cologne, Germany. In this application the applicant has to convincingly show that they still have strong connections to Germany, they are unusually disadvantaged as non-US citizens here in the United States, and they have to justify why they should be allowed to retain their German citizenship.
This can be a daunting task for most applicants, which is why we have been helping our German clients for nearly a decade with this process. We do a thorough assessment for each client, evaluating the chance of success, and we guide them in every way to assure that their application is complete and adequately supported to have the best chance of success.
